| Resume: | Este artículo es una reflexión sobre el sistema pensional colombiano y el principio de solidaridad que impregna la Constitución Nacional de 1991. Con posterioridad la Ley 100 de 1993 consagró la Seguridad Social para todos, pero el sistema pensional hace parte de la Seguridad Social. Sin embargo, la consagración legal muestra una serie de exigencias que permiten concluir que la Pensión solo se puede obtener mediante el cumplimiento de algunos requisitos taxativamente señalados por la misma Ley, lo que reduce su aplicación y lo limita a quienes se encuentran vinculados laboralmente y no a todos los ciudadanos como dice la ley. Para abordar este trabajo se tuvieron en cuenta algunos pronunciamientos de la Corte Constitucional desde 1991. |
| Abstract: | This article is a reflection on the Colombian pension system and the principle of solidarity that permeates the Constitution of 1991. Subsequently Law 100 of 1993 enshrined the Social Security for all but the pension system is part of the Social Security. However, the legal consecration shows a series of demands to conclude that the board can only be obtained by meeting certain requirements restrictively stipulated by the Law, which reduces their application and limited to those who are linked through their work and not all citizens as the law says. To address this work were considered some pronouncements of the Constitutional Court since 1991. |
