Resumen
The purpose of this monograph is to elucidate the manifestations of the Presumption of Innocence in the Special Jurisdiction for Peace (JEP). For this purpose, a qualitative and documentary/bibliographic study was designed applying a non-experimental descriptive methodology. This research analyses the transition from the non-international armed conflict (CANI) between the Revolutionary Armed Forces of Colombia - People's Army (FARC-EP) and the Colombian State, in order to determine the limits of the presumption of innocence of those appearing before the JEP in order to legitimize the justice component of the Integral System of Truth, Justice, Reparation and Non-Repetition (SIVJRNR). This standard of due process is manifested in three ways: as a principle informing the process, as a probative rule, and as a rule of treatment for those who attend transitional peace trials. It should be noted that the presumption of innocence may be relativized when the truth and/or acceptance of responsibility is voluntarily obtained from the person appearing in the case - crimes committed on the occasion of the development of the CANI, on the understanding that the fuller the truth, the greater the proportional benefits will be for those who contribute to guaranteeing the rights of the victims within the JEP.
