This monograph is developed in three chapters that cover the special protection of the disabled worker, taking into account its scope and limitations, what is the normative regulation, the basic guidelines of the constitutional jurisprudence on disability issues, and the protection mechanisms against the unjustified dismissals of employers; initially develops a constitutional and legal framework for the action of tutelage and the weakness that manifests, followed by a jurisprudential line that relates the protection and the exceptional nature of the tutela action as a transitory mechanism in defense of their violated rights.
