According to the Substantive Labor Code, the minimum wage is what every worker has the right to receive to meet their normal needs and those of their family in the material, cultural and moral order. Theoretically, to set it, the cost of living, the differences in work, the conditions of the regions and the economic capacity of the companies are taken into account. Notwithstanding the explicitness of Colombian legislation, we must take into account the purchasing insufficiency of the so-called minimum wage, as well as the existence of groups of isolated workers who, given the need, work for wages below that minimum, without this implying sanctions. of any kind.

De acuerdo con el Código Sustantivo del Trabajo, el salario mínimo es lo que todo trabajador tiene derecho a percibir para atender sus necesidades normales y las de su familia en el orden material, cultural y moral. Teóricamente, para fijarlo se toman en cuenta el costo de la vida, las diferencias de trabajo, las condiciones de las regiones y la capacidad económica de las empresas. No obstante la explisidad de la legislación colombiana, debemos tener en cuenta la insuficiencia adquisitiva del llamado salario mínimo, así como también la existencia de grupos de trabajadores aislados que, ante la necesidad, laboran por remuneraciones inferiores a ese mínimo, sin que ello implique sanciones de tipo alguno.
