The evolution of fundamental rights has led us to a dynamic, where it is not easy to identify which rights should prevail over others; However, the jurisprudential precedent is presented as a conciliatory figure, which develops principles and rules, in search of a solution that seeks favorable aspects for the actors, based on the analysis of the pillars that support the prerogatives in conflict, which must be applied by judicial operators. For this reason, the present investigative work is aimed at structuring a jurisprudential line, from which the position that the Constitutional Court has had during the period 2015 to 2020 is evidenced at the time of making its decisions, when rights collide. fundamentals such as privacy and freedom of expression, in the context of cyberspace, manifested through social networks and more specifically through videos, audios, photographs or messages in memes. Therefore, it is necessary to identify how the closing body of the constitutional jurisdiction uses its criteria to carry out a weighting exercise, observing in a parallel way its evolution, projection, efficiency and legal consequences.
