Due process is considered as the conjunct of judicial guarantees, in the procedure and stages contained in the criminal process, and which, failing that, must be guaranteed to those involved in the process, especially to those who are the object of investigation or prosecution, by the alleged commission of a punishable conduct typified in the Penal Code. Due process in Colombia, enshrined in article 29 of the 1991 Political Constitution, as a fundamental human right and in turn in criminal matters, embodied in Law 906 of 2004, Code of Criminal Procedure, where it is included as part of the principles and procedural guarantees, becomes the backbone of the Criminal Process, considering that if the judicial operator does not protect it adequately, it will be grounds for nullity, due to the violation of fundamental rights of the accused. Consequently, it is considered that Law 906 of 2004, in order to be constitutional, must enshrine and develop each one of the fundamental rights and therefore ensure the development of the principles of freedom, impartiality, equality, defense, presumption of innocence, access to the administration of justice and publicity, as part of the fulfillment of the judicial guarantees enshrined in national and international instruments.
