The current situation of the economy has generated the need to create mechanisms and tools that guarantee the economic viability of citizens, in ruling C 699 of 2007, the Constitutional Court encouraged the Congress of the Republic to create an insolvency regime for people natural non-merchants that were expeditious and simple in order to guarantee their rights and avoid economic collapse, since in Colombia there are more non-merchants than merchants, which is why it is necessary to guarantee a regime that allows the economic rehabilitation of those who went into bankruptcy. The need arises then to regulate the insolvency of the non-merchant natural person, creating a special procedure that regulates the eventual situations in which the subject affected by the cessation of payments was not a commercial legal person or a natural merchant, already regulated in other rules. In this vein, a tour of the general framework of the insolvency situation in Colombia is made, existing regimes are compared, noting differences and similarities, and conclusions are presented.
