The right to due process is composed of other series of guarantees without which it would lose any meaning, therefore the right to defense emerges as an essential nucleus of the right to due process, as in turn the right to defense has an intrinsic relationship with the right to evidence, in this way the parties have the way to provide evidence and also contradict that of their counterpart, likewise the right to evidence uses the normative provisions that are taken regarding the means of evidence, in where are these central axes of this right. In this sense, the Colombian procedural legal system welcomes a numerus apertus position regarding the possibility of providing new means of evidence that are not included in the procedural statutes, however, the General Code of the process welcomes a special connotation regarding testimony technical because it gives some notion about this means of proof, but emphasizing that it associates it with the means of proof of third party declaration enshrined in this statute.
