Resumen
The Colombian State is responsible for the instrumentalization of minors in criminal acts, to the extent that it does not protect or guarantee the effective fulfillment of the rights of children and adolescents, through rigorous and effective regulations against criminal organizations and / or people who instrumentalize these minors, and to the extent that it does not provide effective, adequate and uninterrupted public policies in accordance with the social reality of this vulnerable population, under an articulated system of public policies and regulations that give simultaneous treatment of both its structural causes and its consequences to combat the phenomenon of instrumentalization, in accordance with the principles of the Best Interest of the Child and Comprehensive Protection, established in international treaties, in the National Constitution and in the Childhood and Adolescence Code (Law 1098 of 2006).
