The main function of psychology in the Criminal Responsibility System is to determine the imputability or unimputability of charges depending on the psychological state of the person, in this sense, in this document a literary review is made related to all those legal and psychological aspects related to the Criminal Responsibility System; therefore, the Colombian Penal Code is taken into account, being a norm that contemplates the principles of the right to sanction and the Childhood and Adolescence Code that establishes the standards with which a minor must be sanctioned. Additionally, an approach to the negative aspect that influences Criminal Responsibility is made, such as the simulation of a mental disorder, which serves to mitigate or nullify the responsibility of the criminal act of a subject, finally the fundamental role of the psychologist in the Criminal Responsibility System, mentioning that it is the professional in charge of evaluating the mental state of the person legally involved to subsequently issue an expert opinion.
