Wrongful personal injury and wrongful death in a traffic accident bring with them incapacity, economic loss and permanent consequences, which are summarized in moral damage and the life of the relationship; said injuries or homicides can be reduced or avoided with what is known as the Strategic Road Safety Plan (Hereinafter PESV), which must be designed and implemented by any Company, Entity or Organization of the private and public sector that contracts or manage drivers or have more than ten vehicles (Automotive or not). In Colombia there are regulations applicable to the design and implementation of the PESV, its verification, evaluation, monitoring and sanction for its non-compliance. But the approach to the problem of this research work is non-compliance with the design and implementation of the PESV, by the private sector; but the problem also welcomes the public sector because it is they who must carry out the verification, evaluation, follow-up and the respective sanctions for non-compliance with the PESV; in this way, the private and public sectors do not demonstrate commitment to what could be called "The Culture of Road Safety". When the private and public sectors do not demonstrate commitment regarding Road Safety and compliance with the PESV, the continuous occurrence of guilty personal injury and wrongful death in a traffic accident and road actors (Pedestrian-Driver-Passenger) ) they are not going to commit themselves to diminish or avoid this scourge; which leads to various problems: * An individual problem for the direct victim, due to the economic, physical and psychological repercussions that the traffic accident brings (When there are injuries); * A collective problem for relatives and close friends of the victim, due to the material and non-pecuniary damage caused (When there are injuries and homicide); and * A social problem, for which it transcends the economic, family, labor, professional and productive fields (Loss of income for the home, loss in the family role, loss of job performance and decrease in business production of goods and services, among others). Therefore, it is necessary to list and enunciate in this investigative work, the internal regulations applicable to Road Safety and the PESV, their design, implementation, verification, evaluation, monitoring and sanction for their non-compliance; in order to: * Publicize what could be called "The Culture of Road Safety" to all road actors (Pedestrian-Driver-Passenger), to reduce and avoid injuries and homicide in traffic accidents, both in the work or work space (On mission) and outside it (In itinere). * It also seeks to raise awareness of all companies, entities or organizations in the public and private sector, to design and implement the PESV and carry out such monitoring as stipulated in the Standard, thus avoiding the respective sanctions for non-compliance. Next, after knowing the Road Safety Regulations and the PESV, the reasons why the PESV is not designed and implemented should be listed and stated, this in order to correct and avoid them.
