Resumen
The legal responsibility derived from a traffic accident as a fact generating an obligation, is the central theme of the investigative experience developed, where the substantive norm, Colombian Civil Code, relates the graduation of guilt with the regimes that concern civil liability contractual and non-contractual for road actors involved as victims or victimizers; presents as a differentiating element analyzing the importance of sanitation in this type of process, through the legality control in force of the General Process Code - Law 1564 of 2012 -. Under a study with a documentary and descriptive-explanatory dogmatic approach within the cause-effect relationship, it was possible to establish the legal and procedural implications in difficult cases, where the path of the claim to claim damages and the judge's error are wrong by not making use of the duty-obligation to clean up promptly from the admission of the demand, under pain of nullities, to the detriment of the victims.
