This monograph studies the contractual and non-contractual responsibility of the Colombian State, bringing up the applicable jurisprudence in specific cases of reparation for damages presented by the overcrowding in the country's prisons; a condition that causes the violation of human rights, especially human dignity, so that, when a special relationship is established between the State and the personal deprived of their liberty, it materially enables the second to undertake a process of direct reparation derived from the State responsibility for the breach of specific duties (Decree 1817 of 1964, Law 32 of 1986 and Law 65 of 1993), checking the imputation regime applicable in Colombian law, subjective regime (service failure) and objective regime (special damage) . In effect, the Constitutional Court and the Council of State have dealt with the issue, reiterating the problem of prison overcrowding that is continuously experienced in the country, in which they have referred, that it should not matter if it is a defendant or sentenced, it should guarantee and facilitate dignified treatment in the exercise of administrative activity.
