The study addressed focused on making a comparison of the sanction of Disciplinary offenses between Law 734 of 2002 and Law 1952 of 2019? and the seriousness or lightness of the same, as the starting point to determine the conduct, its nature from the behavior of the intentional or wrongful actions framed within Law 734 of 2002 CDÚ and the new Law 1952 of 2019, we will take the new CGD, unlike Law 734 of 2002, establishing the separation of offenses in order to demonstrate the limit of the penalties to be applied, the above means that public servants who have been penalized in the previous regime for offenses classified as very serious intentional , the sanction remains the same in the new code, not happening the same, when the fault was classified as very serious with very serious guilt, because in this event, the proportionality of applying the disability sanction is reduced by half; This law introduces some concepts to the responsibility structure, defining the concepts of fraud and guilt in disciplinary matters.
