Venezuelan migration is a current phenomenon, which not only affects border communities, but also capital cities such as Villavicencio; However, there is a face that is not analyzed often and is the possible violation that migrant children may have, since they are taken by their parents, as part of the family, in search of stability, that is why the present The study focuses on analyzing the violation of the fundamental rights of Venezuelan children currently living in commune 5 of the city of Villavicencio. The research was carried out under the parameters of the qualitative-quantitative approach (mixed) and descriptive type, supported by documentary records. The results show the identification of the intention of the creation of Law 294 of 1996, the characteristics of the study of international regulations on migrants, especially those aimed at children, applied to the Colombian constitutionality block; the identification of the current Colombian regulations and jurisprudence on migrants, the characterization of the Venezuelan child population that has migrated in the last two years to the city of Villavicencio and the study of the possible relationship between the fundamental right violation of Venezuelan children Villavicencio residents, confronted with state public policies.
