Mortgage loans as instrumentalization of the right to decent housing entails the granting of financial conditions to obtain housing for the Colombian population. However, the form of amortization of these obligations usually lead to confusion given the special attribute of public interest that differentiate them from the rest of mutuals, which is why they are contracts with special clauses that go beyond the will of the parties. Despite the norm, the jurisprudential guidelines and explanatory concepts, the Colombian financial system applies precepts in the liquidation of these obligations that are contrary to law and are framed in financial, rather than legal, technique. The present work addresses the determination of these errors and indicates the settlement of mortgage loans in accordance with the legal precepts.
