This article will deal with Colombian constitutional, legal and international jurisprudence in relation to the protection of the rights of people with cognitive disabilities, where an active role is assumed, through sentences, laws and conventions on the road to the protection of people with disabilities and has referred to their rights on occasional occasions. The article develops an overview of jurisprudential protection around the constitutional obligations of the state with regard to persons with disabilities in relation to the right to education, where it is sought to identify the rights that the population with disabilities has in the Colombian legal system cognitive and, the correlative duties of the State from the international, constitutional and legal approach to inclusive education. The research has a socio-legal nature studying not only the way in which the Colombian legal system has normatively developed the rights of persons with disabilities and the jurisdictional and public policy instruments that have been executed to make them effective, but also critically the effectiveness that those rights and guarantees have in practice.
