This monograph takes as a study the Police Disciplinary Law, understood as part of Administrative Law. From this relationship we intend to examine its legal framework, emphasizing the classification and limits of sanctions, compared to the Constitutional principles of proportionality and guilt, and then take the conclusions of this confrontation. This is motivated, in the regulation that the legislator provided in Law 1015 of the seven (7) of February 2006, Police Disciplinary Regime, which establishes in Article 39 the classification of disciplinary sanctions. Specifically, its numeral 1 constitutes as disciplinary sanction the dismissal and general disability, as a result of behaviors that affect offenses classified as very serious, classified as intent or gross negligence. Hence, the use of two subcategories of guilt in the same rule (Dolo or Very Blame) is striking, with the same consequence. That since it is the labor rights restriction of the police servant, it is necessary to investigate whether this postulate conforms to the Political Constitution of Colombia and the international law.
