The National Government ordered of Law 715 ( 2001) that "... Teachers who work in rural areas of difficult access may have incentives consisting of bonuses, training and time, among others" (Article, 24). In accordance with the regulations, for the application of this article, the Ministry of National Education issues Decree 521 ( 2010), by which partially regulated subsection 6 of article 24 of law 715 (2001) and article 2 of the Law 1297 (2009), in relation to incentives for teachers and teaching managers of state educational establishments located in areas of difficult access. This decree was unified by Decree 1075 (2015), which compiles the regulations of the education sector. However, the theoretical dimension of the Decree is affected by gaps in the legal hermeneutics of the same and the lack of agreement in the relationship between law, history and social reality. Thus, the Decree does not clearly define the way to interpret the criteria established there, to identify these areas, leaving the administrative decision to include or not an educational site in these benefits, directly affecting the income and welfare of the teachers and teaching executives who work there or maybe, allowing the state resources to be misappropriated, due to an erroneous interpretation of the applied jurisprudence.
