The extrajudicial conciliation in Colombia establishes procedural legal consequences "serious indication" to the party that does not attend the conciliation hearing. Failure to appear at the conciliation hearing may be considered as a serious indication against the claims or exceptions of merit in an eventual judicial proceeding to be seen on the same facts, a situation that violates the principle of due process and procedural economy, given that Law 640 of 2001 does not contemplate in its articles the jurisdiction of jurisdiction that if they are regulated in the General Code of the Process (Law 1564 of 2012), generating sometimes that the parties cannot attend the conciliation hearing personally or by means of attorney, for not having sufficient financial resources to move to the conciliation center from your place of residence.
