Publicación Restringido Aborto y delitos sexuales en Antioquia a finales del siglo xix y principios del siglo xx : una historia secreta.(Universidad Cooperativa de Colombia, Facultad de Ciencias Sociales, Derecho, Medellín y Envigado, 2011-09-22) López Osorio, Luz Estella; Del Valle Montoya, Piedad; Hernández Hernández, Oscar IvánEl proyecto de investigación Aborto y delitos sexuales en Antioquia a finales del siglo XIX y principios del siglo XX: una historia secreta presentado por los profesores Piedad del Valle Montoya, investigadora principal, y Oscar Iván Hernández Hernández, coinvestigador, de la Facultad de Derecho de la Universidad Cooperativa de Colombia - sede Medellín fue aprobado y financiado por el Comité Nacional para el Desarrollo de la Investigación (CONADI) y empezó a ejecutarse en octubre de 2008. Uno de los compromisos de esa financiación era la formación y la graduación de un estudiante de pregrado en el marco del fortalecimiento de la comunidad científica. Esa es entonces la razón de este informe que ilustrará sobre las actividades desarrolladas por quien fungió en este proyecto como estudiante en formación. Con este trabajo se pretende igualmente cumplir con el requisito denominado “trabajo de grado” para optar al título de abogada. La dinámica de la investigación es cada vez más importante en las universidades colombianas para obtener registros calificados y acreditación de alta calidad, por un lado, y por otro lado, cumple con la función de replicar el esfuerzo de los docentes-investigadores para el relevo generacional. Este hecho muestra la necesidad de fortalecer los semilleros de investigación, que son los que permiten la iniciación de los estudiantes en el proceso investigativo especialmente en un programa académico en el que tradicionalmente la investigación no ha sido tomada en cuenta como fuente de análisis y reflexión de la propia práctica. Precisamente el semillero “Mórula” adscrito a la línea de investigación Bioderecho del grupo de investigación Jaime Sierra García en su trabajo interdisciplinario ofrece la posibilidad de abordar los asuntos jurídicos como parte de un conjunto complejo dentro del saber propio de las ciencias sociales y humanas. Este informe de trabajo de campo cumple con el compromiso asumido con el CONADI y al mismo tiempo muestra que la investigación es otra forma de asumir la profesión de abogado.Publicación Acceso abierto El aborto: entre el derecho de la mujer y su tipificación como delito "Visión Desde El Derecho Comparado"(Universidad Cooperativa de Colombia, Facultad de Derecho, Derecho, Bucaramanga, 2014) Martínez Rodríguez, Ledy Solange; Tapias Tapias, AmaliaEl presente proyecto tiene como objetivo principal conocer los antecedentes históricos y sociales de la interrupción voluntaria del embarazo, partiendo de un análisis legislativo comparativo entre España, Estados Unidos y Colombia. Conocer los preceptos constitucionales y legales que rigen la práctica del aborto en países vanguardistas como España y Estados Unidos, nos dan un referente para analizar la evolución normativa y jurisprudencial sobre el tema en nuestro país, desde los preceptos constitucionales del derecho a la vida para el que está por nacer, frente al derecho a la libertad, al libre desarrollo de la personalidad y a decidir sobre su cuerpo de la mujer que se encuentra en estado de embarazo. Finalmente se presenta un análisis de la sentencia C-355 de 2.006, que por su contenido, para unos contraria a la Constitución Política y para otros defensora de los derechos de la mujer, marca la historia del aborto en Colombia, al pasar del delito castigado por la legislación penal al derecho custodiado por la Jurisprudencia proferida por la Corte Suprema de Justicia, tan solo en aquellos casos en los cuales no es viable la vida digna del feto y de la transgresión de otros derechos a la mujer por actos de violencia o que ponen en riesgo la continuidad de su propia vida. Recently, through quality of life surveys (ECV), DANE revealed that in 2018 only 52.7% of households had an internet connection, with lack of coverage and lack of devices being the main reasons. Therefore, it is necessary to carry out an analysis of the feasibility and sufficiency of existing public policies in education, as a consequence of the implementation of remote education. This research is qualitative descriptive, consisting of systematically observing the object of study from a political, social and economic perspective. For its development, the method of hermeneutics is used in order to obtain a better interpretation of what is established both in SDG No. 4, of the reports of the Ministry of Education and the public policies adopted in the educational field, allowing to demonstrate how it has been its application and effectiveness. Consequently, a large part of society's activities today require the use of digital tools. However, the use of digital tools depend to a great extent on the internet service. The great shortcomings of the internet service in the country were very evident with the start of the COVID 19 pandemic. Various sectors of society had to migrate to carry out remote activities. Specifically, in the case of education, the virtual education modality was adopted, which was a complex problem in implementation since many children and adolescents lacked internet service in their homes, and the economic situation prevented the prioritization of the service before the most prevalent needs for the home. The Decree of 471 of 2020 by which the State of Social, Economic and Ecological Emergency is established at the national level, as a protection measure to face the health situation known as SARS-CoV-2 or also called COVID-19, likewise, the current decree 806 of 2020 established by the government in order to guarantee access to justice through the use of digital platforms, providing users with legal advice for the resolution of their conflicts; For this reason, the present study's general objective is to analyze the effectiveness of ICTs as a tool for access to justice in Colombia. This analysis responds to the paradigms of qualitative research, making use of the documentary technique to know the impact that ICTs have had in the judicial branch, as well as the effectiveness in streamlining processes, notifications or actions within the due process. The Colombian State does not have the institutional capacity and sufficient economic resources to protect the rights of the displaced population. In order to reach the exposed result it was necessary to made a qualitative research using an ethnographic approach with the place and type of public institutions The investigation allowed to study and collect the information required to establish the contex in which people with disabilities find themselves when they wield the right to education in a public institution. As a result of the processes to conduct the educational inclusivity, identify in a regulation, are far from those that are actually applied because they are not developed in depth. This programs created to reduce the difficulties are ineffective because there is few people considered the needs inside the clasrooms. Depending on the circumstances of the accident, it can be considered as a work accident or non-work accident, the above determines whether it is of common or professional origin. In Colombia the accident in itinere has been little developed while in Chile, Peru, Argentina and Spain it has had a more advanced development in this legal or jurisprudential concept. For the second case, which also implies the first, there are protection mechanisms provided by the law, starting with the 1991 Constitution. One of these measures is the enforcement action, which seeks to "grant to every person, natural or legal, and even to public servants, the possibility of appealing to the judicial authority to demand the fulfillment or fulfillment of the duty that arises from the law or the administrative act and that is omitted by the authority, or the individual when it assumes this character " (Judgment C-157/98). This research examines the effectiveness of this action in the defense of Cultural Heritage, from the legal regulations. It is done with a qualitative approach, of documentary review, at a hermeneutic and phenomenological level.Publicación Restringido La acción de repetición. This overwhelming phenomenon generates a negative impact on public finances as the resources to meet the payment of compensation are increasingly scarce. In this regard, the positive law provides for the action of repetition as a mechanism instituted in favor of the Administration to recover the amounts paid in compliance with adverse judgments, however, the tool has not been successful. Starting from this context, the article highlights the structural failures of the repetition action, among them the gaps and imperfections of the regulations that regulate it and the lack of diligence of public entities to promote the instrument in the judicial process. Consequently, the proposal supported the argument that the increased utilization of this type of judicial protection action in the health care field is the result of administrative failure by health care providers (EPS) to provide the treatments required by the patients. The foregoing is due to the fact that payments due to FOSYGA for high cost treatments and supply of NO-POS medications are not being made, which makes it necessary to resort to judicial action in order to ensure the rendering of these services and payment for said treatments. The goal of the project is to identify the causes that lead to the filing of judicial protection actions in order to guarantee the right to health coverage in the First Oral Administrative Court of the Barrancabermeja Circuit. To this end, it was then necessary to review the rulings in judicial protection cases available in the First Oral Administrative Court of the Barrancabermeja Circuit. Furthermore, the intervening causes in the reviewed cases were analyzed, and the rulings regarding these judicial protection actions were compared; establishing the connections to the various causes, and identifying prevalent factors regarding the common health care needs that are most frequently associated with this type of judicial action. Finally, actions are proposed oriented towards reducing the frequency of judicial protection filings in the area of health care, taking into account the issues which health care providers (EPS) should resolve in a timely manner. The research was conducted using a systematic approach, indirect observation and comparative analysis of the different factors that play a role in the filing of judicial protection actions that will guarantee the provision of appropriate health care
