Maternity has different protection mechanisms, in terms of health and labour rights. This protection extends to the first months of life of the newborn, regardless of the method by which it was procreated. Surrogacy is a permitted procedure in Colombia, however, it has no legal or jurisprudential regulation. Currently, there is only one pronouncement by the Constitutional Court, which mentions the urgent need to regulate surrogacy, to prevent the rights of the newborn from being unprotected. Furthermore, there is no legal norm or judicial decision that refers to the labour rights of fathers who acquire such status through surrogacy as a method of assisted reproduction, creating a vacuum with regard to rights such as maternity leave.
